1.58.010 Public contracts – Notice required – Method.

In all cases where, under the provisions or requirements of the law, or of any ordinance of the city of Hoquiam it shall become necessary to have any public work done by contract, and to let the same to the lowest responsible bidder (notice thereof shall be given by publishing the said notice in the official paper of the city, at least one time, and the said publication shall be not less than ten days prior to the time of letting said contract.)1 Said notice shall contain a statement of the place where said work is to be done, and a brief description thereof, or shall refer to plans or specifications thereof; and a statement of the time when, and the place where, bids therefor will be received and opened; provided however, that the city council of said city of Hoquiam, may, by ordinance or resolution relating to the specific contract to be let, determine and prescribe the contents of the notice, and the place or places, manner, and length of time that the same shall be published or posted. 1.58.020 Public contracts – Bond requirements.

(1) Any person or corporation contracting with the city of Hoquiam to perform public works projects shall make, execute, and deliver to the finance director a good and sufficient bond, with a surety company as surety, conditioned that such person or persons shall faithfully perform all the provisions of such contract and pay all laborers, mechanics and subcontractors and materialmen, and all persons who supply such person or persons, or subcontractors, with provisions and supplies for the carrying on of such work, and any person or persons performing such services or furnishing materials to any subcontractor shall have the same right under the provisions of such bond as if such work, services or material was furnished to the original contractor.

(2) For contracts of twenty-five thousand dollars or less, at the option of the contractor, the city shall, in lieu of bond, retain fifty percent of the contract amount for a period of thirty days after the date of final acceptance, or until receipt of all necessary releases from the Department of Revenue and the Department of Labor and Industries and settlement of any liens filed against the project.

(3) For any public works project of one hundred thousand dollars or less, a cashier’s check drawn upon a reputable financial institution payable to the city of Hoquiam for the full contract amount may be submitted to the finance director in lieu of bond, and held until receipt of all necessary releases from the Department of Revenue and the Department of Labor and Industries and settlement of any liens filed against the project. Applicable section of statute now reads – RCW 35.23.352: Notice of the call for bids shall be given by posting notice thereof in a public place in the city or town and by publication in the official newspaper once each week for two consecutive weeks before the date fixed for opening the bids. If there is no official newspaper the notice shall be published in a newspaper published or of general circulation in the city or town.
